General Terms and Conditions of Sale

1. Purpose

These General Terms and Conditions (GTC) govern the online sale of champagne and limited edition champagne offered by Champagne Lavinista. By placing an order on the website, the customer fully accepts these terms and conditions without reservation.
2. Products

The products covered by this offer include:
• Classic Champagne
• Limited Edition Champagne, available in restricted quantities. Each product is clearly marked as a « limited edition » on the website or in the catalog.
3. Availability and Limited Quantities

The customer is informed that limited edition products are available in restricted quantities. As such, the order will only be validated if the product is in stock at the time the order is finalized. If the quantity ordered exceeds the available stock, the company reserves the right to cancel part or all of the order and issue a refund to the customer.
4. Order Confirmation

An order will be confirmed only after full payment has been received, in accordance with the payment terms specified during the ordering process. The company undertakes to provide an order receipt and to inform the customer via email regarding the confirmation or cancellation of the order.
5. Pricing

The prices of the champagnes (both classic and limited edition) are listed in euros (€), including all applicable taxes (TTC).
The prices and information presented in catalogs, brochures, and price lists are for informational purposes only and are valid at a specific time. Unless otherwise agreed, invoicing will be carried out at the rate in effect on the date of the order.
It is specified that our prices are valid for an average duration of one year and apply to deliveries within a maximum period of 3 months from the date the order is received.
Our prices are valid from January 1, 2025.
In the event of significant fluctuations in the cost of raw materials necessary for production, the seller may adjust the price accordingly, subject to a notice period in line with commercial practices, which will be communicated to the buyer by registered letter with acknowledgment of receipt.
Shipping costs are additional and will be added to the selling price. To obtain an accurate shipping quote, we invite you to contact us for a personalized shipping estimate.
6. Delivery and Incoterm EXW

The seller will make the products available to the buyer at its premises or another agreed location (e.g., warehouse, factory) under the EXW (Ex Works) Incoterm. This means that:
• Delivery is considered complete when the goods are made available to the buyer at the agreed location.
• The buyer assumes responsibility for all costs and risks associated with the transportation of the products, including international freight, export duties, import duties, and insurance.
• The buyer is responsible for the customs formalities for export and import, if applicable.
The buyer assumes all risks from the moment the goods are made available at the agreed location.
7. Payment

All accepted orders will be executed only once full payment has been received, without any discount. Payment can be made via credit card, cheque in euros drawn on a French bank only, cash (euros), or bank transfer. A maximum processing time of 3 days will be applied before shipment.
8. Returns and Withdrawal

In accordance with applicable law, limited edition products cannot be returned or exchanged, except in cases of substantial defects in the product. The customer has a right of withdrawal within 14 days of receiving the order, except for perishable or customized products.
9. Intellectual Property

All intellectual property rights related to the products (including logos, images, descriptions, etc.) remain the exclusive property of Champagne Lavinista Any unauthorized reproduction or use is prohibited.
10. Liability

The company shall not be held liable in cases of force majeure or any event beyond its control that prevents or delays the execution of the order (e.g., strike, weather conditions, etc.). The company’s liability cannot be engaged for any indirect damages arising from the use of the products.
11. Amendments to the GTC

The company reserves the right to modify these General Terms and Conditions at any time. The revised terms will be applicable immediately upon publication on the website.
12. Governing Law and Jurisdiction

These General Terms and Conditions are governed by French law. Any dispute arising from their interpretation or execution shall be brought before the competent courts in the jurisdiction where the company is headquartered in France.
